在本文中,作者深入施米特的《政治的概念》文本,并通过对“正当性”与“合法性”这对重要概念之分析,指出何以施米特对其“政治”概念的论证是失败的。在作者看来,即使在一个渺无和平与正义的现实世界中,只要一个和平乃至正义的世界在规范层面仍是可以设想的乃至可以构想的,那么它对于人类而言便是可以实践的。我们就能够像罗尔斯在其生命最后几年仍坚持的那样,执着地去探索人类世界“可实践的最好极限”。
In this essay, the author goes deep into the text of The Concept of The Political, pointing out why the
reasoning in terms of Schmitt's concept of the political is a failure by analyzing those two important concepts-
legitimacy and legality. According to the author, although it is a world that seems no peace and justice to us now, there is still a practicable prospect to human beings if a peaceful as well as just world is thinkable or conceivable normatively. Hence, we can explore 'the limit of the practical best' of human world just like what Rawls still carried on in the last few years of his life.
