人权的国际保护与国内保护关系辨析

The Analysis of the Relation between the International Protection and Domestic Protection of Human Rights

人权的国际保护与国内保护的关系问题长期以来颇具争论。实际上 ,人权不仅具有国内性质 ,而且具有国际性质 ,因此需要通过国内和国际两方面的渠道来加以保护。人权的国内保护和国际保护是相互制约和相互配合的 ,任何试图割裂二者关系的做法都可能损害国际社会的正常秩序和国家的主权。正确认识二者的辨证关系 ,有助于积极承担国际人权条约义务 ,对人权实施有效的保护 ,促进国内民主法制建设 ;同时也有助于坚持国家主权原则 。

It has been a really controversial issue for a very long time that human rights should be protected through domestic channel or by international society. Human rights are, in fact, both of domestic nature and the international one. So, it should be protected by domestic and international societies. Any attempt to split the relation between the two will certainly harm the order of international society or the state sovereignty. Only with the correct knowledge about the relation can we carry out the efficient protection for human rights and promote the domestic democratic legal construction under the international treaties concerning human rights protection, and at the same time hold on the position of state sovereignty to against any hegemony.
