美国高等教育分权的立法机制探析

On the Separation of Powers on the Framework of American Higher Education Legislation

本文从一般的分权理论引发出美国高等教育立法权的分权实质,然后从高等教育立法权表现在联邦立法制度层面的分权以及在联邦政府与州政府之间的分权入手分析其运行机制,最后指出美国高等教育分权的立法机制的特点。

According to the normal theory of power separation, this paper first examines the essential of separation of powers on the American higher education legislation. Then it analyzes the operation system from the federation of higher education legislation and the separation of higher education powers between the federation and states. Finally the three characteristics of American higher education legislation are put forward.
