集体建设用地流转管理:主要特征、启示借鉴与法律规制——基于广东和成都两地实践与管理办法的对比

Circulation Management of Collective Construction Land:Main Characteristics,Implication and Legal Regulation:A Comparison of Guangdong and Chengdu

研究目的:在集体建设用地隐形流转规模不断扩大但国家法律法规却相对滞后的背景下,深入挖掘具有代表性的广东省和成都市集体建设用地流转管理办法对未来国家层面集体建设用地流转管理的有益启示和可用借鉴。研究方法:比较研究、文献研究和理论研究。研究结果:通过两省(市)管理办法的系统对比分析发现,两地集体建设用地流转管理存在六方面共性特征和六方面个性特征。研究结论:1)两省(市)的立法实践为国家层面未来出台集体建设用地流转管理办法做出了有益探索,积累了立法经验;2)未来国家层面的集体建设用地流转管理办法框架设计应以广东省管理办法为主,成都市管理办法为辅;3)建议修改《物权法》《土地管理法》等法律相关条款以破解法律层面的约束。

Based on a comparison of the management measures of collective construction land circulation in Guangdong Province and Chengdu City,the paper aims to find a beneficial implication for management at the national level.The paper observes that there exist six common characteristics and six personality characteristics regarding the management of collective construction land in the two areas.And the paper concludes:1)the legislation practice regarding management measures in the two areas make useful attempts and provide references for the formulation of management measures of collective constructive land at the national level.2)The future framework design of management measures should mainly draw lessons from the management attempts in Guangdong Province,and take the attempts in Chengdu as a supplement.3)The paper suggests to modify the Property Law,Land Management Law and other related legal provisions to eliminate legal constraints.
