农村集体经营性建设用地入市流转面临的现实问题与对策探讨——以江西省赣县为例

The Problems and Countermeasures of Rural Collective Commercial Construction Land Transfer:A Case Study of Gan County,Jiangxi Province

农村集体经营性建设用地入市流转是我国农村土地制度改革的重要方向,本文在江西赣县调研的基础上,总结归纳农村集体经营性建设用地流转面临的种种现实问题,并提出相应的对策,以期为现阶段开展农村集体经营性建设用地流转试点提供参考。研究表明:农村集体经营性建设用地流转面临着流转对象难以界定,流转潜力并不大;现实情况复杂,新老矛盾交织;流转涉及主体多,利益诉求多样;试点风险高,流转的决策机制难以形成等现实问题。研究提出了相应的对策,应对农村集体经营性建设用地流转现实问题的对策有:同步严格土地征收的适用范围,为农村集体经营性建设用地提供空间;以'多规合一'为契机,明晰农村集体经营性建设用地流转对象;在公平的基础上兼顾效率,制定科学的流转利益分配机制;同步制定农村集体经营性建设用地再次流转制度,为实现与国有土地同权创造条件;完善公众参与机制,构建公平透明的流转决策机制。

In this paper,based on the survey in Gan County,Jiangxi Province,the problems and countermeasures of rural collective commercial construction land transfer are summarized.The problems and countermeasures of rural collective commercial construction land transfer include:the difficulty in defining the purpose of transferring,the low transfer potential,the complex situations and contradictions;the diversified stakeholders;the high-risk of pilot scheme and the difficulty in creating decision-making mechanisms.Finally,the paper proposes a series of measures to solve those problems,such as reforming land expropriation,clarifying the object of rural collective commercial construction land transfer,making the scientific mechanism regarding benefit assignment,making the re-transfer mechanism for rural collective commercial.44 266 construction land and improving the mechanism of public participation.
