论物权变动规则

On the Rules of Property Variation

物权变动规则是我国物权法典的重要内容之一。由于物权与债权有着本质的区别 ,我国的物权立法应当接受物权行为理论 ,建立依法律行为发生的物权变动规则 ,并对现行法律的相关规定进行修改并加以完善。

The rules of property variation is one of the important content in Chinese property code. Because of the essential distinction between property and creditor's right, Chinese property legislation should accept the theory of property behavior, establish the rules of property variation according to legal behavior, and revise and improve the correlative stipulations for current law.
