论我国农民宅基地使用权制度及其完善

On the System of Peasants' Right to Use the Residential Bases and Its Improvement

由于农民宅基地使用权制度所具有的特殊性以及农民相关法律知识的欠缺,农村宅基地使用中各种脱法现象大量存在。笔者认为,对农民宅基地使用权制度从概念、特征、制度现状及其完善等方面作一些探讨,不仅有利于澄清一些错误认识,而且对于我国正在进行的物权立法也会有所裨益。

Owing to particularity of the system of peasants' right to use the residential bases and their lack of knowledge ahout the corresponding law.a lot of lawbreaking phenomena occur in their use of the land. A further probe into the notion, features, current situation and improvement of the system is beneficial not only to clarifying some wrong ideas but to the legislation for the possessive right of articles under way.
