“乱”与“治”:基层法院人民陪审员队伍建设制度研究

Research on People's Juror Construction System of Basic Level Courts

以H省某县法院239名人民陪审员为样本进行考察,可知当前基层法院人民陪审员队伍建设存在学历普遍较低、年龄结构不齐、来源范围不够广泛、专业知识要求过高、管理培训缺位、审陪关系失范等问题。针对这些问题,应树立正确的陪审理念,给予明确的身份地位,建立健全法律法规,完善相关的配套设施,以完善和构建人民陪审员队伍。

By investigation of 239 people’s jurors at a county court of H Province,we know that there are such problems in the basic level people’s juror construction as;low qualifications,poor age structure,not wide range of sources,high requirement of professional knowledge,absence of management and training,and irregular jury relations. Therefore,we should establish correct jury concept,clear the jurors’identities,establish and improve the laws and regulations,and improve the relevant supporting implement so as to construct and improve the jury team.
