农村土地流转是现代农业和新型城镇化发展的重要动力和手段。随着我国农村土地流转进程的加快,农村土地承包经营权流转在资本准入、土地经营行为和政府管理方面的风险也越来越被暴露,这与当前农村土地产权架构不合理的制度性原因和土地流转操作失范的行为性原因密切相关。因此,必须通过上升为法律手段的顶层设计来深化农村土地产权制度改革和切实转变政府职能来防范农村土地承包经营权流转的现实风险。

Rural land circulation is an important motive and means of modern agriculture and new urbanization development.With the accelerating process of the rural land circulation in China, risks of the rural land contract management rights circulation in capital ac-cessing, land management behavior and government management are exposed increasingly.These are closely related to the system rea-son of current unreasonable rural land property rights structure and the behavior reason of anomic land circulation operation.Therefore, the rural land contractual management right circulation’ s real risk prevention must deepen reform rural land property rights system and transform government’s function through the top design raised to legal means.
