论未成年人作为侵权责任主体

Minors as Subject of Tort Liability

未成年人侵权是侵权法中特殊而又重要的问题,近些年未成年人恶性侵权案件多发,现实的需要凸显出立法的不足,我国对未成年人侵权的立法存在诸多问题,甚至并没有明确规定未成年人可以作为侵权责任的主体。法律应当明确未成年人可以作为侵权责任主体,并适用自己责任原则、过错责任原则。立法要在保护受害人合法权益和兼顾作为特殊侵权主体的未成年人之间寻找平衡点。

Minor infringement is a special and important issue in tort law. In recent years,the cases of minors' infringement often appeared,and realistic need shows the problem of the lack of legislation. In China there are many problems in the legislation for minors.Law should be clear that minors can be used as the main body of tort liability,and the principle of liability,fault liability. Legislation is to protect the legitimate rights and interests of the victim and to balance the minor as a special subject of infringement and to find a balance point.
