国际体育仲裁院调解的新发展及对我国的启示

The Enlightenment and New Development of CAS Mediation

调解作为一种非诉讼纠纷解决(the Alternative Dispute Resolution,简称ADR)方式在世界范围内得到广泛应用和推广。通过分析国际体育仲裁院(The Court of Arbitration For Sport,简称CAS)新的调解机制以及CAS推广和发展调解的一系列措施,提出CAS调解将迎来新一轮的发展,这可能为处于困境的我国体育纠纷解决机制提供一个突破的机会。将CAS调解作为我国体育纠纷解决机制替代性途径,并逐步建立和健全我国体育纠纷机制将会是现阶段合适且可行的方法。

Mediation as the way of Alternative Dispute Resolution (ADR) is widely used in the world. This paper based on the analysis of new mediation mechanism of the Court of Arbitration For Sport (CAS)and a series of measures of CAS development and promotion, put forward CAS mediation will have the new devel-opment, this may give a breakthrough for national sport dispute resolution which was in dilemma. As CAS mediation as alternative channel of national sports dispute resolution, and gradually establish and promote na-tional sports dispute resolution mechanism will be appropriate and possible at the present.
