试论政府经济行为的形式规制

On the Form-rule of the Economic Behavior of Government

经济法上研究政府经济行为的重点在于建立市场经济主体运行的规范体系,界定政府经济行为的范围及其运作程序,主要通过设定政府在经济运行过程中的权力与权限来实现政府经济行为规范化的目的。就我国的实际情况而言,追求形式上的规制完整,应是目前政府经济行为法律规制的首要目标。形式上的规制包括程序化规制和信息公开化规制两方面。

The point that economic law study the economic behavior of government is establishing of the running-normal system of market principal part, and define the scope and operating-procedure of the economic behavior of government. It is aim to the standardization of economic behaviors of governments by enacting the power and popedom of government. In regard to our country's actual circumstance, to pursue the perfect form-rule should be the initial target of the standardization of economic behavior of government. The form-rule includes the procedure rule and information disclosure rule.
