网络环境下的著作权保护问题探析

网络以其信息量大 ,传输速度快 ,交互性强等优势 ,被誉为继出版、广播、电视之后的第四媒体 ,并正以其惊人的速度发展。飞速发展的网络改变了人们的生活 ,也对人类现有的法律制度提出了新的挑战 ,网络环境下的著作权保护问题便是当前我国亟需解决的一个新课题。文章拟通过对网络环境下的作品应受著作权法保护 ;网络作品著作权的内容 ;网络作品的法定许可与合理使用 ;网络环境下的著作权侵权责任及赔偿标准等问题的分析 ,同有识之士探讨如何进一步完善我国的著作权法。

With its abundant information,fast speed of transmitting. and strong interaction, Internet is called the fourth medium after publishing,radio and television The development of internet is suprisingly rapid.The rapid development of internet is changing our life,and slmultaneously posing a new challenge to the law system.The question of how to protect the copyright is a new task to our country.In this paper,the author wants to raise for discussion the questionson:the protecting of internet works;the content of copyright in internet works;legal permission and reasonable use of internet works;liability for tort and standard for compensation of copyright in internet environment.
