作为当代政府的一种新型柔性行政方式,行政指导与传统的命令管理模式相比,更多地体现了行政的民主化倾向。学界对行政指导的性质和救济方式存在诸多争议,探讨这些问题具有一定的现实意义。

Compared with the traditional commanding management mode, the administrative instructions, as the new flexible administrative means of the modern government, shows more democratic tendency of administration. The academic circle has disputes over the nature and legal aids of the administrative instructions. So it is of certain realistic significance to probe into these problems.
