我国国家赔偿法亟待确立精神损害赔偿制度

Mental Injury Compensation Should be Regulated in the State Compensation Law

从精神损害赔偿的理论依据出发,对我国《国家赔偿法》中的精神损害赔偿制度进行立法分析,对进一步完善精神损害赔偿制度,使公民人身权、财产权在受到公权力侵害时能得到较为全面的救济具有重大的作用和意义。

Discussing from the basis of theory of mental injury compensation, this article analyzes the legislation of state compensation in our country. The author thinks that it's necessary to show it clearly in legislation and to further improve the system of mental injury compensation, so that citizen's personal rights and property rights could be fully remedied when trespassed by public right.
