On Economic Contract

经济合同是计划经济向市场经济转型过程中产生的。经济合同的本质是国家或政府在经济活动和经济管理中,将其意志直接体现到当事人的契约关系中去,是现代国家对经济实行全面参与和干预的结果。经济合同是经济管理主体之间,经济管理主体与相对人之间为实现一定经济管理和经济协作目标而明确其权利义务关系的协议。经济合同分为国家直接参与经济管理活动的合同和国家不直接参与但体现国家经济管理政策的合同,其中前者又分为政府计划性经济合同和非政府计划性经济合同。

Economic contract is a product in the period of transition from planned economy to market economy in China, its nature being the realization of the will of state or government in the process of economic activity and management. It is divided into two kinds. One is the contract in which the government's will is exhibited but the government does not take part in direct economic management, and the other is the contract in which the government takes direct management of economic activities.
