生育权初探

Study on the generational right

目的 加强对生育权的法律保护 ,以维护公民的合法权益。 方法 从我国现有法律规定出发 ,结合有关法学理论 ,对生育权运行中的具体情形进行分析。 结果 由于立法规定的滞后 ,生育权的内涵及其法律特征现在还不够明确 ,致使司法实践中出现的相关案例常常引发无谓的争议。 结论 为建立完善的生育权保障体系 ,有必要对生育权的法律属性和司法救济途径进行深入探讨。

Objectives To strengthen the legal protection for generational rights and vindicate people's legal rights and interests. Methods According to our current rule of law,we analyzed the specific conditions in running of the generational right. Results Owing to the lag of the legislation,the connotation and character of generational right is still unclear,so that the meaningless controversy often arises in the judicial practice. Conclusion In order to provide a complete system of legal protection for generational right,it is necessary to study the legal attributes and the legal relief of generational right.
