摘要
回疆法文化与大清法文化同属中国传统法文化的组成部分。两者彼此独立 ,又相互冲突和整合。本文首先对学界颇有争议的法文化概念作了界定 ,阐明了两种法文化的关系 ;其次 ,对两种法文化的差异和冲突进行了列举性对比和分析 ;最后探讨了二者在对接、冲突中的整合 ,揭示了不同法文化之间的包容性和互补性。
The legal culture of xingjiang and Qing dynasty beling to chinese traditional legal culture.Theg are independent to each other with conflicts and harmonies.First,the article not only defines the contentious legal culture,but also explains relations between the two legal cultures.Secondly,the article andlyses and tells the diffevences and conflicts between them.Lastly,the narmonies in conflicts will be discussed to indicate mutual complements and tolerance among different legal cultures.
