On the Origin of Modern Chinese Lawyers

律师作为西方法律制度的产物,在中国法制现代化过程中被引进,对中国步向现代法制产生了极其重要的影响。从考察近代领事裁判权及会审制度入手,深入分析在华外籍律师所充当的社会角色及其正反影响,由此探讨了近代中国律师制度及华人律师执业诞生的艰难历程。

Lawyer, as an outcome of western legal system,was introduced in the course of modernization of Chinese legal system and influenced extremely on Chinese legal civilization.Beginning with examining modern Consular Jurisdiction and Joint Hearing System,the thesis explores foreign lawyers′ social role and negative and positive influence,and systematically expounds difficult experience of emergence of modern Chinese lawyer system and Chinese lawyers′ practice.
