浅谈10周岁以上未成年人的民事行为能力问题

A Trial Discussion on the Civil Action's Ability of Minors of Ten Years and Over

随着社会进步和教育水平的提高 ,10周岁以上未成年人的智力发育也日趋成熟 ,其参与社会生活的情形日益增多。因而有必要对这一年龄段的自然人之民事行为能力重新加以分析和研究。本文拟就此问题从历史上寻求其立法本质 ,进而分析我国现行的立法 ,并提出相关的立法建议。

The intellectual growth of minors of ten years and over is increasingly ripe along with the improvement of social progress and educational standards.So,it is necessary to afresh analyze and study the civil action's ability of the natural persons of ten years and over.The author of this article explores the essence of making law concerning the above mentioned,analyzes the present making law in China,and puts forward the related proposals.
