票据利益偿还请求权制度研究

The Study on Claim for Redemption of Interest of Bills——Concurrently discussing with Mr.Zhengmengzhuang and Mr. Jianghongming

利益偿还请求权是票据法基于衡平观念而规定的一项特别请求权。有诸多问题需要辨正、澄清。文章通过对利益偿还请求权制度的概念、性质、条件等问题的阐释,较为中肯地指出我国票据法第18条规定存在的严重缺陷,并提出了相应的修改建议。

On the basis of law of equity the bill law provides claim for redemption of interest. While there are some questions on it and they are required to be distinguished and clarified. The paper explains the concept, characteristic, conditions of it, and then points out that there exists serious defect in the No.18 of bill law in china. After that, the author makes some corresponding suggestions on modification.
