摘要
文章通过对权利起源和权利基础的论述、对权利和义务的关系进行剖析,指出突出法律中权利本性和人文主义有重大的理论和实践意义和建立我国现代法律的权利本位的必要性。
By talking about the rights origin and basic argumentation,the article analyzes the relationship between rights and obligation,and also points out rights nature and humanism have great theoretical and practical meanings in the law and that setting up modern legal rights standard is necessary.
