第三人利益合同制度是对“合同相对性”原则的合理突破 ,但是在我国还没有得到承认。文章从当事人意志的角度出发 ,通过对各国相关制度的比较 ,探析当事人意志在第三人利益合同制度中的地位、价值以及国家对当事人意志的尊重和限制 。

The system on third party beneficiary contracts is a necessary breakthrough for 'doctrine of the privity of contracts', but it hasn't been established in China. This article is to discuss the position, value and restrictions by country of the parties' will in third party beneficiary contract system; moreover, to provide legislative reference to our establishment of the system .
