摘要
我国《民法通则》第65条第3款、第66条第1款规定只是具备了表见代理制度的雏形,《合同法》第49条正式在立法上确认了我国的表见代理制度。但分析表见代理的构成要件及概念,我国在制定民法典时对表见代理制度仍有完善的必要。
The regulations of Section 3,Article 65 and Section 1,Article 66 of China's The General Rules of Civil Law only formed the miniature of the agency by estoppel and Article 49 of Law of Contract affirmed China's agency by estoppel by law. But in the analysis of its components and concepts,we can see it is necessary to perfect the agency by estoppel in formulating The General Rules of Civil Law.
