摘要
"法律体系"是法学基本范畴之一。目前,我国法理学已初步建立起了关于法律体系的基本理论框架,但在许多方面并未取得完全的共识。笔者就法律体系的客观与主观相统一的基本属性、法律体系的外部特征、法律体系与立法体系的关系、法律体系之基本构成要素———法律部门的界定及其划分标准等问题进行了进一步澄清。
Legal system is one of the basic concepts of legal science.The essential theory of legal system has been set up in China,but in certain aspects,the common view has not been achieved.This paper clarifies the following theoretical problems in legal systems:the basic attribute and the exterior character of legal system,the relationship between legal system and lawmaking system,the definition and classification of 'legal branch'.
