依法治校是高校管理现代化的一个重要标志和必然趋势。文章从高校与教师、高校与学生的法律关系入手,着重探讨了高校依法治校的途径:设计制度,完善程序,责任管理,倡导法治精神和维权意识,合理区分学术权力和行政权力。

t It is both an important sign and an inexorable trend for the administrative modernization of the institutions of higher learning to manage the university by law. Starting from the legal relationship between the university and the teachers and the u-niversity and the students respectively, this paper attaches much importance to discuss the ways of ruling the university by law. In other words, how to design the system, how to improve the procedures, how to perfect the duty - bound management, how to advocate the spirit of the rule by law and the awareness of safeguarding the rights as well as how to differentiating the academic rights and the administrative rights properly.
