关于中国法学研究定位的断思

The Thinking of the Orientation of Chinese Legal Research

法学研究的定位是由多种因素促成的。中国法学研究的定位基本上是在学习西方、救亡图存的历史背景下确立的 ,甚至我们对法治的定位也建立在对防止文革重演、繁荣发展经济的基调上。这样的定位所造成的结果是 :对法治价值的追求往往被人们忽略 ,法治的实现方式也因其微小而不被人们重视。但实际 ,真正能够促成法治逐步实现的往往是那些被忽略的具体法律方法。在法学研究的定位上 ,我们不能轻视“从小处着眼”的立场 ,但应注意的是 :从小处着眼并不是就事论事 ,并不是简单的案例分析 。

Many factors resulted in the orientation of legal research.Under the historical background of learning from the west countries and developing china,china came to establishthe orientation of legal research,so much so that the orientation also established the foundation of preventing from reappearance of “canalization Regulation” and developing economy.The orientation leads to people neglected to pursue the value of the rule of law,what's more,because of the unimportance of realization ways of the rule of law,people also ignored them but,in fact,what really facilitate legal method,which was overload by us.When we confirm the orientation of legal reseach,we cannot neglect the position of focusing on the unimportant aspects.But we also should be attention that focus on unimportant aspects doesn't mean consider something as if stads and not refer to simple case analyses.What we should do is dewing ourselves to research the concrete legal method of microcosms [
