论私权之本质——兼论我国私法的建构基础

On the Nature of Private Right

鉴于传统的权利本质学说均无法全面的指出权利的所有特征 ,对于权利本质之研究采要素解释学的方法较为合理 ,研究权利之本质实际上就是确定何种要素为最核心、最基础之要素 ,就是确定权利概念的中心词。私权之最核心和最基础的要素应为自由 ,这是由私权的产生、发展的历史所决定的 。

In view of the fact that the traditional doctrines of the right nature can not explain all the features of right, so it is reasonable to adopt the approach of element explanation to study the nature of right. To study the nature of right is to determine which element is the most essential and basic, that is, to determine the head word of right. The essential element of private right should be freedom, which is decided by the appearance and development of private right. Right standard requires the freedom standard in the construction of private law.
