论入世条件下农业法律体系的生态化构筑——以市场条件下政府职能的转变为视角

生态化建设是现代化的一个基本要素 ,是构筑法治社会的前提和基础。本文以生态学理论作为视角探求构筑中国农业法律体系的生态化 ,实现生态文明时代和政治文明的途径。把生态问题作为法律文化的范畴并纳入人民的视野 ,将中国的农业法制化建设放在入世的条件下思考 ,并从中国文明中寻求借鉴 ,使人类的基本行为规范与价值哲学有机统一 。

Biology construction is a basic element of the modernization and the basis of the laws and rules society. Insight of the biology theory to review China Agricultural Laws System of biology construction is to achieve the transferring from civilization of biology and politic civilization. Putting the environment issues into the laws cultural scope of people's thoughts to constructs and think that China Agricultural laws System and seek a ancient source from China Civilization and combine the human beings' basic activities and value of Philosophy, the issues of the China Laws System and Construction are promoted.
