摘要
刑事契约是辩诉交易与刑事和解的本质特征。基于公正与效率的价值衡量,辩诉交易与刑事和解具有诉讼效率方面相一致的积极性,同时也各自存在着在利益保护之上的分配不均。刑事契约一体化是在辩诉交易基础之上,吸收刑事和解的合理成分而系统化整合的结果。
The essential characteristics of the plea bargaining and the criminal reconciled was the criminal contract. The plea bargaining and the criminal reconciled have the same positive in contentious efficiency. On the basis of the plea bargaining, the criminal contract integration recruited the rational composition of the criminal reconciled.
