摘要
论述了我国现行的工程质量保修制度规定的保修期长,承包人承担的风险大,保修实施的主体单一,业主权益难以得到有效保障等问题。提出了加快工程保修辅助制度建设,形成制度体系;制定合理的工程保修期,降低制度执行成本;推行保修保险制度,分化保修风险等确保工程保修制度能够实现的几个关键问题。
The current project quality guarantee system in China stipulates a long guarantee period. It results in such problems as great risk of contractors, unitary principal part of guarantee enforcement, difficult guarantee of owners' benefit etc. Keys to ensure the fulfillment of the project guarantee assistance and form guarantee system, to establish a reasonable project guarantee period and reduce the cost of system enforcement, and to implement a guarantee insurance system so as to share guarantee risk are presented.
