摘要
我国刑法司法解释存在解释权力的异化、解释主体的泛化、解释内容的分散化、解释效力的矛盾化等问题。目前,"两高"发布具有普遍效力的刑法司法解释具有其历史和现实的原因,但从应然性的角度看,刑法司法解释最终将还原成为一种司法技术。
There are many problems in our judicial interpretation of criminal law such as variability of power,extension of the interpretation body,dispersion of the content,and contradiction of the efficiency.Nowadays,judicial interpretation of criminal law that the Supreme Court and the Supreme People's Procuratorate have promulgated has its historic and practical reasons,but in view of necessitarianism,it will revert to a judicial technology in the long run.
