中国大陆黑社会性质犯罪的主要成因

On Cause of Formation of Crimes Committed by Organizations in the Nature of Criminal Syndicate of Chinese Mainland

我国黑社会性质犯罪与国际上的现代黑社会犯罪尚不能相提并论,还处于一个初步形成阶段。但其的发展经历了上世纪70年代末到80年代中期的低级阶段、80年代末到90年代初期的形成转化阶段和90年代初期以后的扩张和成熟阶段。社会开放过程中产生的负效应、政治上的腐败、境外黑社会组织的渗透、刑事犯罪居高不下和社会控制和打击不力是我国黑社会性质犯罪产生的主要原因。

Chinese crimes committed by organizations in the nature of criminal syndicate could not mention in the same breath as nowadays international crimes committed by criminal syndicate, and are in preparatory process of formation. Its development can be divided into three stages: late 1970's to early 1980's lower stage, late 1980's to early 1990's formation and transformation stage, and outspread and maturation stage after early 1990's. The primary causes of formation of crimes committed by organizations in the nature of criminal syndicate include the negative effect of open process of society, political corruption, penetration of criminal syndicate outside the territory of China, maintenance of higher rate of criminal offense, and unsatisfactory social control and measures against crimes.
