论我国科技创新风险投资的法律环境

On the Legal Environment for the Venture Investment of the Scien-tech Innovations in China

建立风险投资制度来解决企业在科技创新中的资本缺口问题,是一种有益的尝试。为了促进创业投资业的发展,建立有利于风险投资发展的法律环境,我国颁布了一些法律、法规、规章,但是这些规定过于原则,缺乏相应的制度支持。根据我国现行风险投资法律制度和美国优化风险投资法律环境的做法,应当完善我国风险投资法律环境。

It is a kind of beneficial trial to solve the shortage of capital in the enterprises' science and technology innovation by establishing the venture investment system. In order to promote the development of venture investment and to establish the legal environment favorable for the venture investment, China has promulgated some related laws, rules and regulations. But these laws, rules and regulations are only in principle and are short of corresponding systematic support. In accordance with our country's present laws concerning venture investment and some practices of optimizing the legal environment for venture investment of the United States, this article points out that we should perfect our country's legal environment for venture investment.
