中国国际法学的繁荣之路:一种引入国际关系理论分析的路

The Way to the Prosperity of China’s International Law:A trial of Introducing the Theoretical Analysis of International Relations

若从改革开放时算起,国内的国际法研究已经走过三十年。在这三十年里,国内国际法研究取得了前所未有的成就,并初步建立起一个体系健全的学科。不过,由于在研究方法上的单一与贫乏,尤其是对实证主义分析方法的过度依赖,使得国内的国际法研究总体上呈现出"注释法学"的特征,在理论研究上更是处于一种"贫乏"状态。无疑,中国国际法学的繁荣,必须摆脱对实证主义分析方法的过度倚重,从相关学科,包括国际关系学、国际经济学、政治学、哲学等,汲取知识与方法上的必要养分,走跨学科的"学科整合"之路径。其中,通过国际法与国际关系的跨学科合作,是国内的国际法研究走出当前困境,实现理论繁荣的一条必经之路。从效果上来看,国际关系理论可以从宏观、中观以及微观层次给予国际法的发展现象提供各种解释,以及产生程度不一的影响。

Since 30 years ago when the reform and opening-up policy began to implement,our study of the international law has gained the unprecedented achievements and put into place a sound academic system.However,the study of international law in China only stayed on the level of legal interpretation and the relative theoretical study was at the edge of poverty.The reasons not only lied in deficiency of research method,but also rest with over-dependence on analytical positivist jurisprudence.Undoubtedly,the interdisciplinary study is necessary for the development of social sciences,and the disciplinary integration is also imperative for the prosperity of China’s international law’s study by getting rid of the over-dependence on analytical positivist jurisprudence and by absorbing knowledge and methodologies from other related subjects including international relations, international economics,politics,philosophy,etc.To get away from predicament existing in research and achieve prosperity of theory,it is worth trying to overcome their obstacles by virtue of promoting the inter-discipline cooperation between international law and international relations.To be specific,the definition,methodologies as well as materials with respects to international relations can offer advantageous help for the prosperity of international law.The international relations research can provide various explanations at macro-view,medium-view and micro-view levels and have different influences.
