摘要
非全日制用工在全球范围迅速发展的同时,也面临着诸多的困境。为此,国际劳工组织、欧盟均制定了相关的框架性规范,强调非全日制劳动者的平等待遇、保障非全日制就业与全日制就业间的自愿性转换等。与此相比,中国非全日制用工立法过于强调用工的灵活性,而忽视非全日制劳动者就业的安全性,造成非全日制劳动者的权益严重受损等问题。因此如何在强调非全日制就业灵活性的同时,保障非全日制劳动者就业的安全性,是中国进行相关立法时不得不慎重考虑的问题。本文通过分析相关的域外立法经验,反思中国非全日制用工立法存在的问题,提出相关完善建议。
Part-time work is in the rapidly growing trend across the world,and facing with many problems as well.International Labour Organization and the European Union have established the framework of legislation,emphasizing the equal treatment of part-time worker,and ensuring the voluntary transfer between full-time work and parttime work,etc.By contrast,the legislation of part-time work in China cannot solve those problems effectively,which overemphasizes on the flexibility in employment,while the employment safety of part-time worker has been neglected.Therefore,combining the flexibility of part-time work and the security of part-time worker should be further enhanced by legislation in China.Basing on analysing the relative foreign legislation,we review the legislation of part-time work in China,and propose some improvement suggestions.
