论海洋石油开发环境污染损害赔偿法律机制之构建——以国际法和我国法为视角

Construction of Offshore Oil Development Environment Pollution Damage Compensations Legal Mechanism ——From the Perspective of International Law and China Law

随着海洋石油资源开发的日益蓬勃,海洋石油开发中的巨大环境污染风险逐渐引起了国际社会的重视。然而,目前国际社会尚未有任何生效的政府间国际条约来专门调整和规范这一问题,仅有一部未生效条约和一个民间协定。如何在充分开发和利用海洋油气资源的同时,合理预防其对海洋环境造成的巨大污染,并在污染发生后进行及时有效的救济,已成为世界各国和我国共同面临的紧迫课题。要构建这一法律机制,首先要对国际社会海洋石油开发环境污染损害赔偿的国际立法尝试进行深入分析,吸纳其合理成分,结合国际社会和我国发展的需要,构建起系统的国际法和我国法中的海洋石油开发环境污染法律赔偿机制。

With the booming of offshore petroleum resources exploration and exploitation,the huge risk of environmental pollution has gradually attracted the attention of the international community.Yet,there’s no specific treaty in force on offshore oil development environmental pollution,except for an international treaty not yet in effectand an international non-governmental agreement How to well protect the marine environment during development and utilization of offshore oil and gas resources,and give reasonable,timely and effective remedies after the contamination,is the common urgent question which the international community and China has to face.We must first make analysis of the international legislative attempt of the international community in the offshore oil development environment pollution damage compensation,absorb reasonable ingredients,consider the international community and China’s development needs,and build up the system of international law and a Chineselegal mechanism on offshore oil development environment pollution damage compensation.
