论网上交易平台对概括性仲裁协议效力的影响

A Probe into Online Trading Platforms’ Influence on the Validity of General Arbitration Agreement

为了维护网上交易的秩序和安全,网上交易平台在一定程度上从市场的'参与者'转变为市场的'管理者',引导当事人选择网上仲裁解决争议。在此背景下,本文提出了概括性仲裁协议的概念,从当事人合意、当事人经济关系两方面分析了概括性仲裁协议的成立。然后从网上交易平台对双方当事人真实意思表示的影响分析了概括性仲裁协议是否有效。最后针对不同情形对概括性仲裁协议进行了完善。

To maintain the online transition order and to grantee the safety of online commercial activity,online trading platforms have gradually transformed from the original’ market players’ to ’ market regulators’ who recommend online arbitration in cases of any disputes.Analyzed in this context,the concept of ’ general arbitration agreement’ has been discussed in this paper.This paper discusses the establishment of the agreement from two aspects of the’ consensus and economic relationships between the parties,and the online trading platforms’ influence on the effectiveness of the agreement In the last section,the author gives the suggestions about how to better the general arbitration agreement.
