网络攻击与战争法的适用

War by Internet Cyber Attack and Application of Law of War

随着网络技术的不断普及和应用,互联网和信息通信技术已经完全融入到人类社会生活的各个方面,控制了制造业的基本流程、政府系统、公用事业、银行业、通讯业等涉及国家经济和安全的部门。在这种背景下,跨国网络攻击对国家所造成的危害日益凸显,但对现有体制的审查发现,它只能适用于解决部分网络攻击所构成的战争问题,国际社会需要从补充完善现有规则或者制定一部综合性规制网络攻击的国际法文件的方法中选择可行的道路,我国应在应对跨国网络攻击的国际立法中坚持主权和资源平等立场,共享人类文明的新成果。

With the growing popularity and applications of Internet technology,the IT technology has been fully integrated into all aspects of human social life and controlled the national infrastructure,government,utilities,banks and communications consist of the country’s economic and security system.In this context,the damage caused by transnational network attacks can comparable to traditional war,but the review to the existing system of law of war demonstrates that it can only be applied to solve part of issues arising from the war of cyber attacks,so the international community needs to viable path either to supplement and improve the existing rules or to develop a comprehensive law to regulate network attacks.
