论国际体育法规则的识别——以CAS仲裁裁决为视角

The Characterization of International Sports Law——In the View of Cases of CAS

2012年伦敦奥运会召开前,国际体育仲裁院(CAS)在前后两个仲裁裁决中,首次提出国际体育法适用的识别问题。针对这一国际体育法理论与实践的基本问题,本文借助法律识别理论和仲裁庭裁决,结合体育的特殊性,概括了国际体育法规则识别过程中的重点与难点,归纳出国际体育法的识别方法:其一,明确识别主体的权限。其二,坚持实质重于形式的识别原则。其三,在识别中运用法律解释方法。以期高效解决体育法规则之冲突,为国际体育法规则的适用提供有效指引。

CAS had ruled two cases about the characterization in International Sports Law at first time before 2012 London Olympic Games,which is the fundamental issue in theories and practices of International Sports law.The research is from the point of the theory of Characterization,analyzing awards of CAS with the specificity of Sports,concluding features and difficulties of Characterization,and proposing the characterization of the scope of subjects ’ authority,the principle of ’ substance over form’,and the application of legal interpretation.It could settle down conflicts among rules effectively and provide efficient guide to apply the International Sports Law.
