摘要
On International Interests of the Cape Town Convertion《开普敦公约》及其《开普敦议定书》于2001年通过,2006年开始生效。公约的目标是保护担保债权人和所有利害关系人的利益,增加可预测性,降低风险和减少融资费用。为实现此目标,公约规定了国际利益制度,这是公约重要的创新做法,含义宽泛,内容丰富,涉及面广,成为公约及其议定书的主题。鉴于此,本文以《开普敦公约》为框架,以国际利益为主线,全面分析国际利益问题的界定,国际利益的公示机制'登记'问题,登记后的效力问题,国际利益持有人转让国际利益,以及国际利益的效力受到损害时如何救济的问题,阐明我国相关立法存在的问题,并提出对策,使之具有更好的可操作性和可行性。
The Cape Town Convention and its protocol was passed in 2001 but only came into being in 2006.The aim of the protocol is to protect the secured creditors and the interests of its stakeholders.It further increases predictability,reduces risk and diminishes financing costs.The convention provides an international interests system where emphasis is placed on innovation and a broad spectrum of content.With this being the core focus of the convention a comprehensive analysis would have to be offered and within the context of the international world a suitable definition is required. " Registration" or even public registration will then also become a matter of concern hence why the definition will have to be defined well so that legislation can be clarified and measurement for effectiveness can be determined.Not all parties can be satisfied but a benchmark can be set.Therefore,ironing out the common problems amongst the stakeholders to assist in minimizing the damages and further offering counter measurements to make the process more feasible and operable will be imperative.
