论"一带一路"倡议下以铁路运输为中心的国际货运规则重构

The Reconstitution of Rules on International Carriage of Goods Mainly by Railway in "One Belt and One Road" Initiative

在"一带一路"倡议下的国际货物运输中,铁路运输将发挥重要作用。目前亚欧大陆以铁路运输为中心的国际货物运输存在的主要法律障碍是运输规则不统一,因此,应当改革当前以《国际货协》和《国际货约》为核心的铁路运输规则体系,制定统一的以铁路运输为中心的国际货运规则,以进一步推动"一带一路"倡议的实施。

Under 'One Belt and One Road'Initiative, railway transport can play an important role in the international transport within the Euasian Continent. Currently, there are many obstacles on the international carriage of goods mainly by railway within the Eurasian Continent.From the legal point of view,the lack of unified rules and the disharmony of the existing rules for international combined transport are the main problems. Thus it is necessary to reform the existing rules. In order to further promote the implementation of the'one belt and one road'initiative, a unified convention on international carriage of goods mainly by railway should be taken into consideration based on the current two conventions on railway transport.
