论国际法的编纂与逐渐发展——纪念联合国国际法委员会成立七十周年

On Progressive Development and Codification of International Law:In Commemoration of 70 Years of the International Law Commission

"没有法典,就没有正义。"国际法法典化是法学家的梦想,也是联合国宪章确定的目标。联合国国际法委员会的成立是国际法百年编纂与发展史的转折点。本文旨在通过对国际法委员会70年工作及其贡献的回顾和对国际法编纂与发展现状的客观分析,探讨进一步增强国际法委员会能力和贡献的方式、方法。文章认为,国际法委员会在法律编纂、拟定公约方面成就卓著,尤以外交、领事、条约、海洋、国际刑法诸领域突出;在逐渐发展和研究方面,也取得多项重大理论突破。但受制于国际关系的现实以及国家的政治意愿,其作用仍有待加强。国家始终是国际法逐渐发展和编纂的源动力和驱动力,应发挥更积极的作用;国际法委员会本身的工作方法问题也不容忽视。世界要和平,各国要发展,都离不开法治和秩序。国际法委员会使命神圣,作用不可替代。70周年是契机,要为未来谋平衡,努力实现国际关系法治化目标。

'To be without a code is to be without justice.' It has long been a dream to embody in codes all rules of international law. UN & ILC represented a turning point in this regard. 70 th anniversary of ILC provides an ideal opportunity to celebrate its achievements and contemplate its future work.ILC has played an indispensable role in setting forth basic rules in key areas such as diplomatic and consular relations, the law of treaties, the law of the sea and international criminal justice. It has also contributed in a substantial way to the progressive development of the law. However, subject to the reality of international relations and the political will of states, its role still needs to be strengthened. The states have always been the source and driving force for the progressive development and codification of international law. Suggestions are thereby made to draw a balance for the future. All countries should work together to build an international community with a shared future and based on the justice and rule of law.
