浅析公益诉讼制度在退役电子产品环境污染防治中的应用

电子产品的不断更新换代,造成全球退役电子产品的产生量大、增长速度快,大量的退役电子产品得不到充分的循环利用,一方面造成了资源的极大浪费,另一方面更是对全球的环境造成了严重的破坏。为此,各国政府在如何有效防治退役产品污染方面都在不断加大防治力度,也有很多国家通过制定完善法律制度对退役电子产品的回收再利用及销毁方式进行了强制性的政策规定。而环境污染关系到公民的切身利益,公民的环境权利意识开始觉醒,环境公益诉讼应运而生。环境公益诉讼是在传统诉讼制度无法应对严重的环境生态危机的情况下产生的一种新的诉讼形式,自20世纪70年代在美国建立以来,已经被许多国家纷纷效仿。在退役电子产品的污染防治中,公益诉讼制度的应用具有重要的意义。

The continuous upgrading of electronic products,production caused by global retired electronic products,rapid growth rate,retired a large number of electronic products is not sufficient cycle use,on one hand,causing a great waste of resources,on the other hand is on the global environment caused serious damage.Therefore,governments on how to effectively control pollution retirement products have increased prevention efforts,there are also many countries through the development of perfecting the legal system of electronic products recycling retired reuse and destroy mode of the mandatory policy.Environmental pollution is related to the vital interests of citizens,citizen's environmental rights consciousness awakening,environmental public interest litigation emerge as the times require.Environmental public interest litigation is a new form of litigation can not cope with the environment caused serious ecological crisis in the traditional litigation case, since the establishment of the United States of America in the nineteen seventies, has been to many countries.[Zhang Bailing, fan Juan:"theory"of the environmental public interest litigation,"Journal of Yunnan University law"in 2010 fourth edition.In the prevention and control of pollution retired electronic products,has important application of public interest litigation system.
