一方面侧重从经济基础的层面论证取得时效制度的外在功用,另一方面着眼于从上层建筑层面探寻采用取得时效制度来配置权利的内在根据。最终证成取得时效制度与消灭时效等制度应是相辅相成、和谐自怡的统一整体,在即将颁布的民法典或在物权法典中设立取得时效制度是我国社会主义市场经济走向高效化、国际化的必要路径。

On the one hand, this paper emphasizes particularly on argumenting the outside functions of positive prescription,with a view to the economic foundation. On the other hand,reasons its inner bases with a view to superstructure. Ultimately, the paper concludes that positive prescription and negative prescription should be an entity in perfent harmony Code to be issued, the system of positive prescription should be set up. Moreover, it is a necessary means for China to acclerate and internationalize its socialist market economy.
