On Intellectual Property Protection of Intangible Cultural Heritage

非物质文化遗产是人类创造的宝贵财富,是当今经济发展的一种重要资源。将知识产权保护制度引入非物质文化遗产领域,并结合非物质文化遗产的特殊性对传统知识产权制度的主体、客体、内容、期限等进行必要的扩张和创新,是保护非物质文化遗产的有效方法,值得我国在非物质文化遗产立法中给予足够重视。

Intangible cultural heritage, a precious wealth from and for the human beings, has nowadays become an important resource in developing our economy. In China, we should pay due attention to the protection of the intangible cultural heritage in the legislation by introducing, which are to introduce the system of intellectual property rights protection into the field of intangible cultural heritage,to enlarge and innovate subject, object, content, deadline, etc.according to the particularity of intangible cultural heritage, in the traditional intellectual property system.
