摘要
推进公众参与,构建社会共治体系,已经成为现阶段我国食品安全风险治理体系改革和创新的基本共识。但在实践中,一些制度方面的障碍和缺陷,导致了公众参与积极性不高、参与深度和广度不够、参与无序等问题。应当通过健全举报人保护和奖励制度、构建信息披露交流共享机制、探索食品安全公益诉讼制度、加强对职业打假人的法律规制等措施,提高公众参与食品安全风险治理的有效性。
To promote public participation constantly and build the system of society multi-governance have become the basic consensus of governance system reform and innovation of China’s food safety risk at this stage.However,in practice,there are some institutional obstacles and defects in public participation,which results in low enthusiasm for public participation,insufficient depth and scope of participation,and disorderly participation etc.We should improve the institution of public participation and improve the effectiveness of public participation in governance of food safety risk,through establishing legal system to protect the rights and interests of the whistle blower,setting up information communication and sharing mechanism,exploring the public interest litigation system,and regulating occupational anti-counterfeiter.
