国际海洋划界裁判中的“司法能动主义”——以200海里外大陆架划界问题为例被引量：6

“Judicial Activism” in International Adjudication on Maritime Delimitation——The Delimitation of Continental Shelf beyond 200 Nautical Miles as an Example

摘要国际海洋划界是国际司法机构实践"司法能动主义"的典型领域。在联合国大陆架界限委员会(CLCS)完成200海里外大陆架提案的审议工作之前,越来越多的海洋划界争端当事国开始请求国际司法机构在裁决200海里以内海洋边界的同时,一并划分200海里以外的大陆架。鉴于CLCS避免卷入海洋划界争端的一贯立场,国际司法机构如若坚持以"定界"为"划界"的前提,便有可能产生海洋划界争端中的"管辖权黑洞"。为化解这一僵局,国际司法机构近年来坚持严格区分"定界"和"划界",同时为管辖200海里外大陆架的划界争端创设了门槛标准,彰显了"司法能动主义",然而,国际司法机构裁决200海里外大陆架界线时产生的新问题,亦反映出"司法能动主义"的局限性。综合国际司法裁判的结构性因素和情境性因素,未来国际司法机构应适度回归"司法克制主义",谨慎对待"管辖权黑洞"问题。
