网上证券交易的法律监管机制初探——以美国为主要借鉴对象的研究

A study on regulation mechanism of on-line securities exchange

网上证券交易又被称为是证券电子商务,是网络技术在证券市场环境中的广泛适用而出现的新型的证券交易方式,其一出现,即引来世人的瞩目。另一方面,证券监管机构也因为其的出现带来的一系列新的问题而备感头疼。在网上证券交易方兴未艾之际,探讨相关的法律监管问题是非常有意义的,尤其重要的是构建起相应的监管机制的问题。本文结合有关资料,在分析网上证券交易市场结构、监管内容以及必要的法律框架的基础上,结合美国的网上交易监管机制,提出了不同的监管模式,期望对构建我国的网上证券交易监管机制作出一点抛砖引玉的贡献。

On-line securities exchange is also called securities of e- commerce,and it is a consequence of the network technique being extensive used in the stock market.with its emergence,namely attracked focus attentioning of persons in the world.However,the security regulators also found it difficult to deal with because there are series of new problems from its emergence.With the securities of e-commerce on the up moment,it's meaningful that we study the related law of regulation.As the particularly important,it is an initial problem that how to establish the regulation mechanism.Relevant data of combination of this text,on the foundation of the analysis of the market construction of on-line securities exchange,what to need regulations and the necessary law frame,joining the regulation mechanism of the United States,we bring up different regulation mode,and so expect to contribute to establish our country's regulation mechanism of t on-line securities exchange.
