摘要
TEACH Act对1976年美国版权法作了修改,将合理使用延及到了数字化环境下的远程教育。同时,为切实有效保护版权人的权益,对远程教育机构及其信息技术人员、教师作了具体的要求。通过分析TEACH Act,并反观我国的版权制度,会发现其已不适应现代远程教育的发展,有必要予以修改。在修改时,可以借鉴TEACH Act的相关经验。
TEACH Act modifies America's Copyright Law of 1976, extending the fair use to the distance education under digital circumstances. Meanwhile,in order to efficiently protect the right of copyright's owner,it also set up specific requirements for the institutions of distance education, relevant technical staff and teachers.Through the analysis on TEACH Act, we can find out that China's institutions of copyright does not adapt to the advances of distance education and necessary amends should be made with the help of the useful lessons drawn from the TEACH Act.
